CLARIFICATION TEXT

 

The purpose of this clarification text is to inform you about the scope of the processing of your personal data by Volta Motor Sanayi ve Ticaret Anonim Şirketi (“Volta/Data Controller”) within the scope of the Personal Data Protection Law No. 6698 (“Law”), secondary legislation, and the decisions of the Personal Data Protection Board.

 

1. PURPOSES OF PROCESSING AND TRANSFERRING PERSONAL DATA AND THEIR LEGAL GROUNDS

 

Which data will be processed by the Data Controller may vary depending on various factors such as the type and nature of the relationship between the data subject and the Data Controller, and the communication channels used.

 

a) Product Sales and Delivery

 

The personal data listed below of our customers who sign a distance contract with the Data Controller are processed by the Data Controller within the scope of the processing purposes and legal grounds listed below.

 

For the purpose of concluding a distance contract with our customers (and in this context, communication, information, finance/accounting processes, and management of requests and complaints) and fulfilling the Data Controller's obligations under trade, tax, electronic commerce, and consumer law legislation, the following data may be processed based on the legal grounds of “being clearly stipulated in the laws” regulated in Article 5/2(a) of the Law, “it being necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract” regulated in Article 5/2(c), and “it being mandatory for the data controller to fulfill its legal obligation” regulated in Article 5/2(ç) of the Law.

Customer Transaction Information Order and invoice details

 

In the event that a distance contract is concluded, your full name, Turkish ID number, phone number, and address data are transferred to our affiliates and suppliers, contracted cargo companies, or private couriers based on the aforementioned processing purposes and the legal ground of “it being necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract” regulated in Article 5/2(c) of the Law.

 

The payments you make will be processed through the website payment service provider [.]'s page, and your credit card and/or bank account details, as well as your device ID and internet protocol (IP) address, will be processed by [.]. Your personal data listed above may be transferred to authorized public institutions and organizations based on the legal ground of “it being mandatory for the data controller to fulfill its legal obligation” regulated in Article 5/2(ç) of the Law for the purpose of ensuring that activities are carried out in accordance with the legislation and providing information to authorized persons, institutions, and organizations, and to consultancy firms providing support in fields such as law and tax based on the legal ground of “it being necessary for the establishment, exercise, or protection of a right” regulated in Article 5/2(e) of the Law for the purpose of following up and executing legal affairs.

 

b) Customer Satisfaction and Quality Improvement

 

Requests and complaints you report to us via the Data Controller’s contact form, call center, [.] internet address, and other channels, your full name, phone number, and e-mail address information, and your transaction history regarding your purchases are processed based on the legal grounds of “it being necessary to process data for the legitimate interests of the data controller” pursuant to Article 5/2(f) of the Law and “it being mandatory for the data controller to fulfill its legal obligation” regulated in Article 5/2(ç) of the Law for the purposes of post-sales goods/services support, tracking requests/complaints, carrying out customer satisfaction activities, and fulfilling the legal obligations specified in the legislation to which the Data Controller is subject, primarily the Regulation on Distance Contracts, and/or in decisions, guidelines, and manuals published by authorized authorities.

 

2. METHOD OF COLLECTING PERSONAL DATA

 

Personal data is collected through automated or non-automated means by the data subject themselves via verbal and written notifications made through the Website, e-mail, and mobile communication tools.

 

3. HOW AND FOR HOW LONG WILL PERSONAL DATA BE STORED AND HOW WILL IT BE DESTROYED?

 

The personal data of the data subject may be stored in [.]'s database for 10 years. Upon the expiry of the relevant period, your personal data will be deleted, destroyed, or anonymized in accordance with the Regulation on the Deletion, Destruction, or Anonymization of Personal Data.

 

4. RIGHTS REGARDING THE PROTECTION OF PERSONAL DATA

 

In accordance with Article 11 of the Law, data subjects have the right to contact the Data Controller and:

 

• learn whether their personal data is being processed,

• request information if it has been processed,

• learn the purpose of processing and whether it is used in accordance with its purpose,

• know the 3rd parties to whom it is transferred domestically/abroad,

• request correction if it is processed incompletely/incorrectly,

• request its deletion/destruction,

• request that the transactions performed in accordance with correction, deletion, or destruction requests be notified to the 3rd parties to whom the data is transferred,

• object to the emergence of a result against them due to it being analyzed exclusively by automated systems,

• request compensation for damages in case they suffer damages due to it being processed unlawfully.

 

To exercise your rights stated above, you may submit your request, which includes the necessary information to identify you and your explanations regarding the rights you wish to exercise from among those specified in Article 11 of the KVKK, by filling out the “Data Subject Application Form” located on the website with the domain name https://volta.com.tr/ fully and completely, and by delivering a wet-signed copy of the form personally to the address Selamlar Köyü Selamlar Mevkii Gümüşova OSB 1. Sokak Blok No: 10 Gümüşova / DÜZCE, or by sending it via a notary public or by other methods specified in the Data Subject Application Form.

 

Your requests in your application will be concluded by Volta Motor free of charge as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request. However, if the process requires an additional cost for Volta Motor, the fee in the tariff determined by the Personal Data Protection Board will be charged.

 

In accordance with Article 10 of the KVKK titled “Data Controller's Disclosure Obligation”, I have read and understood this Clarification Text prepared regarding by whom my personal data will be processed and for what purpose, to whom and for what purpose the processed personal data may be transferred, the method and legal ground of personal data collection, how and for how long the processed personal data will be stored, and my rights in Article 11 of the KVKK and how I can use them, and I have been informed in detail about this by Volta Motor, who holds the capacity of data controller.
